Yes, Dual Pricing is 100% legal in all 50 states. It’s compliant with Visa, Mastercard, and other major credit card brands, as long as both prices are clearly displayed to the customer before the transaction.

How is Dual Pricing different from a surcharge?

​A surcharge is an additional fee added only to credit card transactions, while Dual Pricing offers two distinct prices upfront—one for cash and one for card payments. In some states, surcharges are restricted or illegal, but Dual Pricing is compliant nationwide. Also Dual Pricing also covers the fees charged on Debit Cards - where surcharges cannot be added to Debit cards - costing the business about 1.5-2% of Sales.
